Jurisdiction: Refers to the authority of a court to hear and decide a particular case. It involves a determination of whether the court has the power to hear a case, based on the subject matter, geographical location, and parties involved.
Pleadings: Refers to the various documents filed by parties in a civil case, including the complaint, answer, and counterclaim. These documents are used to lay out the parties' claims and defenses, and the issues that will be decided by the court.
Discovery: Refers to the process of obtaining information from the opposing party in a civil case. It involves various tools such as depositions, requests for documents, and interrogatories.
Motions: Refers to requests made by parties to the court asking for a ruling or order on a particular issue in the case. Examples include a motion for summary judgment, motion for judgment on the pleadings, and motion to dismiss.
Trials: Refers to the process of presenting evidence and arguments to a judge or jury to decide the outcome of a civil case. This includes jury selection, opening and closing arguments, examination of witnesses, and presenting evidence.
Judgments: Refers to the final outcome of a civil case, including monetary damages, injunctions, and orders for specific performance.
Appeals: Refers to the process of challenging a trial court decision by requesting a higher court to review the decision for legal errors. It involves briefing and arguments by the parties and decision by the appellate court.
Class Actions: Refers to a type of lawsuit in which a large group of people collectively bring a claim against another party. It involves a determination of whether the claims can be brought collectively, and how the damages will be distributed.
Alternative Dispute Resolution: Refers to methods of resolving legal disputes without going through a formal trial. This includes mediation, arbitration, and negotiation.
Enforcement: Refers to the process of enforcing a judgment or other court order, including garnishing wages, seizing property, and holding individuals in contempt of court.
Disciplinary proceedings: A type of civil procedure that deals with the misconduct of professionals such as lawyers, doctors, and accountants.
Small claims court procedures: Small claims court procedures are designed to quickly and efficiently resolve disputes involving small amounts of money.
Class action procedures: A class action is a type of lawsuit in which a large group of people sues a defendant for a specific reason.
Arbitration proceedings: A type of civil procedure that involves resolving disputes without going to court, using an arbitrator as a neutral third party.
